MONDAY, JUNE 13
Gerald David Rising, 67, of Cortez, was found guilty of one count of assault third degree-knowingly/recklessly causing injury and was sentenced to 60 days in jail, to begin serving sentence on June 17, with 18 days credit for time served. He was also sentenced 24 months of supervised probation, and was ordered to pay $1,551.80 in fines and costs. Additionally, he must obtain a domestic violence evaluation and follow all recommendations of treatment, and must submit to random tests for drugs and alcohol. Defendant must also pay restitution as ordered, and must not operate a motor vehicle without a valid drivers license. The defendant must not contract any financial obligations without approval of his probation officer and/or his collections investigator. All standard conditions of probation apply, including no alcohol or illegal drug use. Defendant must also report to state probation as of this date. Upon reporting to jail, defendant is to provide information regarding medical issues upon reporting to jail and verify that they have the ability to handle such medical issues.
Gerald David Rising, 67, of Cortez, pleaded guilty to one count of protection order violation, and was ordered to pay $212.50 in fines and costs. He was additionally ordered to comply with probation requirements concurrent with the above-listed Case No. 10M312.
Damon Deon Abeln, 41, of Cortez, pleaded guilty to one count of harassment-strike/shove/kick and was sentenced to 15 days in jail, beginning June 17, with seven days credit for time served, and serving on weekends allowed. He was also sentenced to 12 months supervised probation. The defendant also was ordered to pay $857.50 in fines and costs, and must undergo a domestic violence evaluation and follow all recommendations for treatment. He must submit to random tests for drugs and alcohol as instructed by his probation officer, and must participate in a parenting class such as the Fatherhood program at the Nest or a similar program. Standard conditions of probation apply, including no alcohol or illegal drug use. Defendant was ordered to report to state probation as of this date, and must not contract any financial obligations without approval of his probation officer and/or collections investigator. A protection order remains in effect.
Eric H. Boyd, 42, of Dolores, pleaded guilty to one count of harassment-strike/shove/kick and was sentenced to five days in jail, beginning June 17, with one day credit for time served, and weekend service authorized. He was also sentenced to 24 months probation, and ordered to pay $1,512.50 in fines and costs. Defendant must obtain a domestic violence evaluation and follow all recommendations, obtain a substance abuse evaluation and follow all recommendations. He must submit to random tests for drugs and alcohol as instructed by his probation officer. Additionally, the defendant must perform 24 hours of useful community service, to be completed by May 13, 2012. Defendant is to be referred to vocational rehabilitation, and is required to follow all recommendations of probation, and shall not contract any financial obligations without approval of his probation officer and/or collections investigator. A protection order against the defendant is modified to allow written and telephone contact.
Nathaniel Woody, 38, of Cortez, pleaded guilty to one count of harassment-strike/shove/kick and was sentenced to 120 days in jail with 53 days credit for time served. He was ordered to pay $240.50 in fines and costs, and must obtain a domestic violence evaluation and a substance abuse evaluation, and follow all recommendations of both.
Nathaniel Woody, 38, of Cortez, pleaded guilty to one count of protection order violation-criminal and was sentenced to 120 days in jail with 53 days credit for time served, concurrent with the above noted case. He was ordered to pay $209.50 in fines and costs.
TUESDAY, JUNE 14
Andrea A. Martinez, 48, of Cortez, received a deferred sentence for one count of harassment-strike/shove/kick and was ordered to pay $184.50 in fines and costs. Additionally, she must violate no laws, traffic or criminal, and must keep her address current with the court.
Jimmie D. Phillips, 41, of Cortez, pleaded guilty to one count of driving after revocation-prohibited. He was sentenced to 60 days in jail, with 14 days credit for time served. He was also ordered to pay $214.50 in fines and costs.
Curtis D. Hatch, 23, of Cortez, pleaded guilty to one count of assault third degree-knowingly/recklessly causing injury. He was sentenced to 45 days in jail, reporting on June 21, and to 24 months probation, supervised. He was ordered to pay $1,246 in fines and costs, and must obtain and complete a domestic violence evaluation and follow all recommendations of same. A protection order remains in effect during the probation period. This case is concurrent with Case No. 11M64.
Curtis D. Hatch, 23, of Cortez, pleaded guilty to one count of driving under the influence. He was sentenced to 365 days in jail, suspended, plus 10 days jail, stayed. Work release is authorized. He was also sentenced to 24 months probation, concurrent with Case No. 10M566, and ordered to pay $764.78 in fines and costs. He was ordered to complete 60 hours of community service by June 14, 2012. He must attend Victim Impact Panel, and level two education and 68 hours of Track C enhanced outpatient therapy. He must submit to random tests for drugs and alcohol. All standard conditions of probation apply, including no alcohol or illegal drug use. Defendant must follow all conditions of probation, and must report to state probation on this date.
WEDNESDAY, JUNE 15
Lindsay Kay, 40, of Cortez, pleaded guilty to one count of reckless endangerment and was sentenced to 12 months of probation, unsupervised, and was ordered to pay $434.50 in fines and costs. The defendant must violate no laws, traffic or criminal and must keep his address current with the court. He must obtain a drug and alcohol evaluation and follow all recommendations of same. Additionally, he must write a letter of apology to the victim. A portion of his fine is suspended with the condition of successfully completing probation.
Lisa Raylene Hawes, 33, of Cortez, pleaded guilty to one count of reckless endangerment and was sentenced to 12 months of probation, unsupervised. She must complete 48 hours of community service by May 15, 2012, and was ordered to pay $184.50 in fines and costs. She must violate no laws, traffic or criminal, and keep her address current with the court. She must also obtain a drug and alcohol evaluation and follow all recommendations of same. A portion of her fine is suspended with the condition of successfully completing probation and evaluation recommendations. She must write a letter of apology to the victim.
Kelli N. Sanders, 25, of Cortez, pleaded guilty to one count of possession of drug paraphernalia and received a deferred sentence of 12 months, unsupervised. She was ordered to pay $26 in fines and costs and must violate no laws, traffic or criminal and keep her address current with the court.
Christopher Don McCabe, 19, of Cortez, pleaded guilty to one count of fishing without a license. He was ordered to pay $76 in fines and costs.
