Local prosecutors plan to retry a Bloomfield man on charges of careless driving resulting in injury and death after a mistrial earlier this month.
A jury could not come to a unanimous decision in January about the guilt of Donald Mills, 30, who prosecutors and law enforcement say caused a head-on crash in December 2018 on U.S. Highway 160, west of Hesperus.
The crash killed Tary Martinez, 56, of Cortez and injured her husband, Douglas Martinez, and two grandchildren, who were ages 8 and 5 at the time.
A two-day jury trial is scheduled for March 19. Law enforcement does not suspect drugs or alcohol were a factor in the crash.
Mills has been accused of one count of careless driving causing death and three counts of careless driving causing bodily injury. If convicted, he could be sentenced to 10 days to a year in jail and fined $300 to $1,000.
