DUI Convictions

The following are convictions made for driving under the influence with a blood-alcohol content of 0.08 percent or higher or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the following: drug/alcohol evaluations, Victim Impact Panel, Attitudinal Dynamics of Driving, Level II education and therapy, Alive at 25, inpatient and/ or outpatient treatment or therapy, and must submit to random tests for drugs and alcohol use. Suspended imposition of additional jail sentence (in parentheses) is conditional upon completing probation successfully and are awarded if all other requirements of the sentence are completed within one year. Dollar amounts are fines and court costs defendants were ordered to pay.

TUESDAY, OCT. 23

Ÿ Stacson Lee Salt, 28, of Towaoc. This is defendant’s first conviction pursuant to 42-4-1307(9). Seventy-six days in jail with 76 days credit for time served, 12 months probation, $998.50 (additional $300 suspended imposition), community service 48 hours.

DWAI Convictions

The following are convictions for driving while ability impaired with a blood alcohol content between 0.05 percent and 0.08 percent or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the classes or programs listed above in the DUI category; additional listed conditions also apply

TUESDAY, OCT. 16

Ÿ Isaac M. Roe, 30, of Cortez. Twenty days under electronic surveillance, (365 days in jail with suspended imposition), 12 months probation, $1,030 (additional $300 suspended imposition), community service 48 hours.

TUESDAY, OCT. 23

Ÿ Sherm Lansing, 31, of Ismay, Colo. (Thirty days in jail with suspended imposition), 12 months probation, $768.50 (additional $100 suspended imposition), community service 24 hours.

Ÿ Floyd Steven Hight, 36, of Towaoc. This is defendant’s second conviction. Additional ten days in jail with 60 days credit for time served (additional 365 days in jail with suspended imposition), 12 months probation, $1,053.50 (additional $300 suspended imposition), community service 60 hours.

Domestic Violence

The following cases of domestic violence require those convicted to attend and complete one or more of these additional classes or programs in addition to jail time, probation, fines and community service: domestic violence evaluation, substance abuse treatment and testing, inpatient treatment and anger management.

MONDAY, OCT. 22

Ÿ Matthew R. John, 25, of Teec Nos Pos, Ariz. Menacing. Sixty days in jail with 18 days credit for time served, 24 months supervised probation, $1,513. There will be zero tolerance for any violations of sentencing conditions.

WEDNESDAY, OCT. 24

Ÿ Carlena Begay, 33, of Pinon, Ariz. Third-degree Assault – Knowingly/Recklessly Causing Injury. Sixty days in jail with 60 days credit for time served, 24 months supervised probation, $1,527.80, community service 24 hours.

WEDNESDAY, OCT. 24

Ÿ Neco A. Escoe, 18, of Cortez. Possession of Marijuana – under 2 ounces, $431.

Ÿ Darrel Dee, 30, of Blanding, Utah. Possession of Marijuana – under 2 ounces. $431.

Ÿ Asian C. Josley, 30, of Blanding, Utah. Possession of Marijuana – under 2 ounces. $431.

Ÿ Johnathan P. Snow, 20, of Cortez. Possession of Drug Paraphernalia. $131.

Ÿ Dustin Whittenburg, 18, of Cortez. Possession of Drug Paraphernalia. $131.

OTHER

TUESDAY, OCT. 23

Ÿ Uriah J. Barr, 20, of Cortez. Driving Under Restraint. Twenty days under electronic surveillance, $209.50.

Ÿ Julius Begaye, 34, of Cortez. Driving After Revocation Prohibited. (Ninety days in jail with suspended imposition), $209.50, community service 200 hours.

Ÿ Joseph A. Afterbuffalo, 39, of Bluff, Utah. Driving Under Restraint – Alcohol-related. Seventeen days in jail with credit for time served, deferred sentence of 12 months probation, $209.50. Defendant must obtain drivers license within the next 12 months and provide proof to the court. A deferred judgment is not a conviction; it is a sentence typically put off (deferred) for a specific period of time, typically a year. If the defendant complies with each of the conditions of the deferred sentence within the allotted time period, the defendant’s record is cleared of this charge.

FRIDAY, OCT. 26

Ÿ Justin L. Johnson, 23, of Dove Creek. Driving Under Restraint. Thirty days in jail with 30 days credit for time served, $214.50.
