DUI Convictions

The following are convictions made for driving under the influence with a blood-alcohol content of 0.08 percent or higher or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the following: drug/alcohol evaluations, Victim Impact Panel, Attitudinal Dynamics of Driving, Level II education and therapy, Alive at 25, inpatient and/ or outpatient treatment or therapy, and must submit to random tests for drugs and alcohol use. Suspended imposition of additional jail sentence (in parentheses) is conditional upon completing probation successfully and are awarded if all other requirements of the sentence are completed within one year. Dollar amounts are fines and court costs defendants were ordered to pay.

TUESDAY, OCT. 9

Ÿ Larry R. Scardino, 60, of Mancos. (Thirty days in jail with suspended imposition), 12 months unsupervised probation, $1,330, community service 48 hours.

Ÿ Nathaniel Dutchie, 21, of Towaoc. Thirty days in jail, 12 months extended probation revoked, 12 months private probation revoked, $1,088.50, community service 48 hours. Probation issued Oct. 9, 2012 is revoked and terminated as unsuccessful.

Ÿ Nathaniel Dutchie, 21, of Towaoc. Driving Under Restraint – Alcohol-related. Thirty days in jail, $239.50.

DWAI Convictions

The following are convictions for driving while ability impaired with a blood alcohol content between 0.05 percent and 0.08 percent or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the classes or programs listed above in the DUI category; additional listed conditions also apply

TUESDAY, OCT. 2

Ÿ Danielle L. Westbrook, 48, of Dove Creek. This is defendant’s 2nd conviction. Ten days in jail (additional 365 days in jail with suspended imposition), 24 months probation, $1,028.50, community service 48 hours.

Domestic Violence

The following cases of domestic violence require those convicted to attend and complete one or more of these additional classes or programs in addition to jail time, probation, fines and community service: domestic violence evaluation, substance abuse treatment and testing, inpatient treatment and anger management.

TUESDAY, OCT. 9

Ÿ P.J. Chavez, 43, of Cortez. Harassment – Strike/Shove/Kick. Twenty days in jail with 20 days credit for time served, 18 months probation, $1,240.50.

Ÿ Carl D. Hamlin, 39, of Cortez. Third Degree Assault – Knowingly/Recklessly Causing Injury; and Protection Order Violation. On Count #1, updated sentence of 24 months probation, community service 48 hours. On Count #2, 11 days in jail with 11 days credit for time served, $1,631.80. Restitution is open for 90 days.

Ÿ Carl D. Hamlin, 39, of Towaoc. Protection Order Violation. Sixty days in jail with 10 days credit for time served, $220.50.

Ÿ Ivan William Doka, 38, of Dinnehotso, Ariz. Harassment – Strike/Shove/Kick, 22 days in jail with 22 days credit for time served, $241.

Ÿ Ivan William Doka, 38, of Dinnehotso, Ariz. Violation of Bail Bond Conditions – Misdemeanor, 180 days in jail with 1 day credit for time served, $184.50.

TUESDAY, OCT. 9

Ÿ Shane J. Rulli, 32, of Cahone. One count of Theft – Under $500, one count of Menacing. On Count #1, 90 days in jail with 66 days credit for time served; on Count #2, 90 days in jail with 66 days credit for time served, concurrent with Count #1, $290.50.

Ÿ Loren Wilson, 38, of Cortez. Criminal Mischief – under $500. *Deferred sentence of 12 months probation, $854.50.

WEDNESDAY, OCT. 10

Ÿ Annette L. Carrasco, 35, of Dolores. Ownership of a Dangerous Dog. $234.50. Restitution is open for 90 days.

Ÿ Anthony D. Bearshead, 21, of Towaoc. Driving without a Driver’s License; Driving without Insurance. On Count #1, deferred sentence of 12 months unsupervised probation; on Count #2, *deferred sentence of 12 months unsupervised probation, $131.50.

Ÿ Josefino Abrigo, 46, of Monument Valley, Utah. Speeding 20-24 mph over speed limit. $276.50.

*A deferred judgment is not a conviction; it is a sentence typically put off (deferred) for a specific period of time, typically a year. If the defendant complies with each of the conditions of the deferred sentence within the allotted time period, the defendant’s record is cleared of this charge.
