Judge: Grounds for excessive force in raids

A federal judge has ruled that the family of Dr. James Redd may pursue allegations that a federal agent used excessive force during the 2009 antiquities raids in Blanding, Utah, according to the San Juan Record.

Redd took his own life shortly after the raid.

Daniel Love, an agent for the BLM, conducted the raids.

In a morning raid on June 10, 2009, Redd and dozens of others were arrested related to the sale of artifacts.

Dozens of armed agents participated in the raids. Redd’s family charged that the agents violated Redd’s Fourth Amendment protection against excessive force.

Federal judge Robert Shelby dismissed four of the five claims, but ruled that the family could move forward in the excessive-force claims against Love.

5 plead not guilty in Recapture protest

Five Utah men have pleaded not guilty to federal charges relating to the Recapture Canyon protest on May 10, 2014.

A two-day trial is scheduled for Dec. 22.

The misdemeanor charges allege that San Juan County Commissioner Phil Lyman, Monte Wells, Shane Marian, Trent Holliday and Jay Redd conspired to break the law by organizing the protest and by protesting.

Each faces two misdemeanor charges with possible penalties of one year in prison and a $100,000 fine for each charge.
