Court briefs: Gun-wielding assailant beaten

The tables were turned against a convicted felon who held a Mancos man at gunpoint in August.

The alleged victim, a 23-year-old Mancos man, escaped any known injuries after he reportedly punched the gun-wielding assailant, Daniel Holley, 28, of Cortez, in self-defense. Police said Holley suffered a black eye and bloody nose.

Police allege that Holley held a .40 caliber semi-automatic pistol to the victim’s jaw on Aug. 3, after a dispute with his girlfriend on Navajo Street.

Free on a $2,500 bond, Holley is charged with menacing, possession of a weapon by a convicted felon and prohibited use of a weapon. The defendant’s scheduled arraignment hearing last week was postponed until next month after he appeared via telephone without the court’s permission.

Holley was previously convicted of motor vehicle theft in 2008.

Man jailed on $100K bond in sex case

A Cortez man remains jailed on a $100,000 bond after his arrest on child sexual-assault charges in July.

David Adcock, 44, of Cortez was arrested and charged with two felony counts of child sexual assault. The crimes allegedly involve a 10-year-old on July 27.

Court records reveal police seized a desktop computer, bedding and clothing from the defendant’s North Washington Street residence days later. Authorities suspect child porno may be present on the computer.

The alleged victim told authorities that Adcock touched him after visiting the defendant’s home to swim in a hot tub.

The defendant’s arraignment is set for Nov. 20.

8th DUI lands Towaoc woman year in prison

A Towaoc woman was sentenced to a year in prison after pleading guilty to her eighth DUI in September.

Alexandra Silas, 39, was also sentenced to one year of suspended jail, three years of probation and 80 hours of community service. Upon her release, Silas was also ordered to neither drive nor possess automobile keys while on probation.

“You’re endangering everyone in our community,” District Court Judge Todd Plewe told Silas.

Court records reveal Silas was arrested and charged with DUI after driving without headlights down Main Street in Cortez just after midnight on March 22.

According to court officials, Silas was previously convicted of four DUIs in Montezuma County and four in Towaoc. She’s also been charged 10 times for driving without a license since 2003.

Man wants to serve time, go home to mom

A Wyoming man will spend about 75 more days in jail after being convicted of possessing drugs.

Robert Rose, 45, pleaded guilty last week to possessing 0.2 grams of meth. He requested an immediate sentence so he could return to Wyoming to care for his aging mother.

Rose was sentenced to 10 months in prison with credit for serving 225 days since his arrest on March 14. Rose was convicted on similar charges in 1995.

The recent Cortez Police Department drug charge was initially filed in connection to a Nov. 5, 2013, incident on North Sligo. The charges were dismissed for unknown reasons, but later re-filed by prosecutors in March.

Sentence for long joyride will be in Dec.

A 21-year-old woman who pleaded guilty to aggravated motor vehicle theft will be sentenced in December.

Prosecutors said Tonya Chavez took the vehicle from an East Downey Street residence on Nov. 15, 2013, and didn’t return it till 12 days later.

In custody on unrelated misdemeanor charges, Chavez pleaded guilty to the felony last week. If she’s unable to complete the terms of the deferred judgment, she could be sentenced to 18 months in jail and a year of parole. She will be sentenced under a tentative 24-month deferred judgment plea deal on Dec. 18.

Mom charged with harboring offender

A Mancos mother of a 3-year-old charged with harboring an unregistered sex offender has decided not to represent herself.

Caitlin Trevino, age unknown, appeared in court last week and told the court she no longer wanted to be represented by a public defender. The judge warned that would be the worst decision she could make.

After consulting with her attorney, Trevino decided not to represent herself. A continuance was granted until Nov. 4 to consider a possible plea deal.

Court records reveal Trevino repeatedly told law enforcement agents in February that a convicted sex offender was not inside her Country West Motel apartment in Mancos. Authorities later found the subject, who had two warrants for his arrest, hiding in the defendant’s attic.

Free on a $1,500 bond, Trevino is charged with accessory to a crime, hindering the apprehension of a suspect for failure to register as a sex offender, providing a false report to authorities and child abuse.
